General Terms and Conditions

Ownership: All photographs, images, videos, and content created by Light House Media, including but not limited to real estate photography and videography, virtual tours, and any other related media, are the exclusive property of Light House Media.

Restrictions: Clients are prohibited from sub-licensing, selling, or otherwise transferring the license or usage rights to any third party without the express written consent of Light House Media. Images and videos may not be altered, edited, or manipulated in any way that would compromise the original artistic intent created by Light House Media. This is at the discretion of Light House Media.

Ownership Acknowledgement: Light House Media retains copyright ownership of all media. Acknowledgment is not required for standard listing marketing purposes. However, if additional licensing is granted for uses such as portfolios, editorial publications, or social media campaigns unrelated to the specific listing, acknowledgment may be required as part of the terms of the additional license.

Exclusivity: Unless otherwise agreed upon in writing, Light House Media retains the right to use the photographs and videos for self-promotion, portfolio, marketing, and any other purposes.

Termination of License: Light House Media reserves the right to terminate or modify the license granted to the client in case of breach of these terms and conditions.

Governing Law: These Terms and Conditions are governed by the laws applicable in the jurisdiction where services are rendered. Any disputes arising from these terms will be resolved in accordance with the applicable laws of that location.

Matterport Virtual Tours: Matterport tours will be hosted until the property is sold, or with a maximum of 6 months. Once the hosting time expires, the client is responsible for any desired permanent media storage. Additional hosting is available upon request, and fees may apply.
First Shoot Promotion: 50% OFF

Light House Media offers licensed real estate agents a promotional discount for their first photo shoot, in the amount of 50% off. Minimum $200 spend.

Please note that this discount is applicable exclusively to licensed real estate agents for listing services only, and Light House Media reserves the right to modify or withdraw this offer at its discretion, and/or to update invoices to appropriately apply the correct discount.
Cancellations and Property Readiness

Cancellation and Rescheduling Fees: Appointments canceled with less than 24 hours notice may incur a $100 cancellation fee. Reschedules request with less than 24 hours notice may incur a $50 rescheduling fee. This will be charged at LHM's sole discretion, based on our own schedules and availability.

Getting Ready Guide: Clients are strongly encouraged to review and utilize our Getting Ready Guide to ensure the property is prepared before we arrive for the shoot. This guide provides valuable tips for making the home photo-ready, particularly if a professional staging company is not being used.

Weather-Related Reschedules: Severe weather conditions, such as storms, heavy rain, or other unsafe circumstances, may require rescheduling. In these cases, no rescheduling or call-out fee will be applied. However, if the weather allows for interior-only shots, the client may choose to proceed with the interior shoot as scheduled.

Emergency-Related Reschedules: In the event of unforeseen emergencies that are beyond the control of both the client and Light House Media (such as power outages, natural disasters, or other exceptional circumstances) reschedules will be accommodated without any additional fees.

Property Readiness and Rescheduling Fees: If the property is not ready upon the photographer's arrival, or if there are any preventable conditions (such as, but not limited to, locked properties, unready homes, or unexpected trades) that delay the shoot by 30 minutes, or require complete rescheduling, the client will be subject to a $50 call-out/reschedule fee plus applicable travel fees.

Order Details & Accuracy

Square Footage Accuracy: Where required, the client is expected to have accurately entered or communicated all pertinent information at the time the order is placed. We reserve the right to update incorrect information and adjust the pricing of the order to reflect the correct details (e.g., if the client states the property is 1800sqft but it is actually 2200sqft). Invoices will be adjusted accordingly, as our pricing changes with square footage.

Address Accuracy:

​Clients are responsible for ensuring that the property address submitted at the time of booking is complete, accurate, and corresponds with the correct town or city.

To assist with this, our booking system offers auto-fill suggestions, as well as a “Need Help?” button that allows clients to manually enter an address and drop a pin on the correct location. We encourage all users to double-check this information carefully before confirming an order.

Once a booking is submitted, confirmations are sent via email and text (if selected), and a calendar invitation is provided. It is the client’s responsibility to review these details and notify us of any discrepancies as soon as possible.

If an incorrect address is submitted and not corrected before we arrive at the appointment, and once we contact the agent, the following applies:

If our schedule allows, we will proceed to the correct location. An extra travel fee will be applied, based on the additional distance traveled.

If our schedule does not allow for the immediate change, the shoot must be rescheduled or cancelled. In this case, the client will be charged a rescheduling or cancellation fee, as well as the originally applicable travel fee based on the incorrect address provided.

We understand that timing is often critical, and if the agent chooses to use another provider, they are welcome to do so. However, the applicable fees will still be due based on the time and resources committed to the original booking.

Ensuring address accuracy helps us serve you better, stay on schedule, and avoid unnecessary delays for all parties involved.

Scope of Work: Our typical pricing reflects the cost for a residential listing. For commercial or multi-unit properties, please contact us for a personalized quote.

Travel Ranges and Fees: Travel is free within our included service area. For distances beyond that, additional fees apply. Fees vary per service area. Travel fees are automatically calculated online, based on the address entered, and must be agreed to before placing your order.​​ Travel Fees are based on one-way travel from our launch locations, and calculated in 2-mile increments.

Amarillo, TX: 30 Miles included, additionally $2/mile​.

Bozeman, MT: 15 Miles included, additionally $2.75/mile.

Shawnee, OK: 25 Miles included, additionally $2/mile.

Provo, UT: 20 Miles included, additionally $2.50/mile.

Oversized Scans and Floor Plan Fees
​
For properties exceeding standard size limits, oversized scan fees apply. These fees are determined by the total square metres scanned, not just the total living square metres. This includes all scanned areas such as walls, garages, alfrescos, or any additional spaces included in the scan.

These fees are in addition to standard pricing and reflect the increased time and resources required for larger properties. If the client provides inaccurate property size (or no size at all) during booking, any applicable oversized fees will be added to the final invoice based on the actual size scanned.

By placing an order, the client acknowledges and agrees to these fees being added when applicable.

Licensing Agreement and Copyright Notice
​
All photos, videos, and media provided by Light House Media (LHM) are protected under U.S. copyright law and remain the exclusive intellectual property of LHM. We do not sell our media — instead, we grant a limited-use license to our clients.
​
By using our services, you (the client) are granted a non-transferable, non-exclusive license to use the delivered media solely for marketing the specific property it was created for. This includes use on MLS, property websites, social media, and printed or digital marketing materials directly related to that listing.
​
This license is valid only for the duration the property is actively listed for sale or lease. Once the listing is sold, leased, withdrawn, or expires, your license to use the media ends automatically.

At that point, you agree to:

Stop using the media on any platform or in any promotional materials.
Media may not be reused for other properties, agents, brokerages, or marketing campaigns without prior written permission. Any continued use beyond the license period is unauthorized and may be subject to legal action.

This arrangement is a temporary license for limited use — not a sale. Light House Media retains full ownership of the media at all times.

Optional USB Add-On:
If you purchase an optional USB add-on containing the media from your listing, please note that this is provided as a convenient, offline method of delivery or for personal purposes only. This item is fulfilled separately via our Montana branch (LHM MT LLC), and shipped directly to the client or agent. No tax due under MT law. This does not alter the licensing terms above. Use of the media must still cease once the listing concludes, regardless of how or where the files are stored.

Because of this licensing structure:

In Texas, our services qualify as a copyright licensing arrangement and are exempt from sales tax under Texas Administrative Code Rule 3.312.

In Oklahoma, media delivered under a license agreement without transfer of ownership is considered a nontaxable service under current tax guidance.

In Utah, licensed use of copyrighted media, where no ownership is transferred, is treated as a nontaxable service, not the sale of tangible goods.

In Montana, there is no state sales tax, and our services are not subject to local sales tax.

By placing an order or booking a session, you acknowledge and agree to these terms in full.​
Changes to Terms and Conditions
​
Light House Media reserves the right to update or modify these Terms and Conditions at any time without prior notice. It is the responsibility of the client to review and agree to the Terms and Conditions before each booking.
By continuing to use our services, the client agrees to be bound by the most current version of the Terms and Conditions.
